By accessing and using the Zeneith platform ("Service"), you ("User," "You") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (the "Agreement") and all policies referenced herein.
If you do not agree with any provision of these Terms, do not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the modified Terms.
Zeneith provides an Zeneith service that analyzes how your brand ranks across generative AI platforms (ChatGPT, Google AI Overviews, Gemini, Claude, Perplexity, Grok, DeepSeek) based on AI-generated queries. Results are provided "as-is" based on publicly available information at the time of evaluation.
⚠️ Important Limitations:
Zeneith grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes in accordance with these Terms. You agree NOT to:

Zeneith reserves the right to suspend or terminate accounts suspected of fraudulent activity, unauthorized use, or violation of these Terms.
Zeneith offers multiple subscription tiers with varying features and query limits. Plan specifications are subject to change at Zeneith's discretion. We will provide 30 days notice for material changes affecting existing paid subscribers.
Available Plans:
Payment Authorization
By subscribing to a paid plan, you authorize Zeneith to charge your payment method (credit card, UPI, bank transfer) for the subscription amount. You are responsible for maintaining current payment information.
Automatic Renewal
Paid subscriptions renew automatically on the anniversary date unless cancelled before renewal. You will receive renewal reminders via email 7 days before renewal.
Failed Payments
If payment fails, we will attempt re-charge within 5 business days. Continued failure may result in account suspension until payment is resolved.
Taxes
You are responsible for all applicable taxes. Zeneith will collect and remit GST (Goods and Services Tax) for Indian customers as per Indian tax law. Prices shown may exclude GST, which will be added at checkout.
NO REFUNDS ARE ALLOWED UNDER ANY CIRCUMSTANCES.All payments are final. Once a subscription is activated, no refunds or credits will be issued for any reason whatsoever, including but not limited to: - Change of mind - Dissatisfaction with results - Technical issues - Incorrect plan selection By clicking 'Subscribe', you explicitly acknowledge and accept this non-refund policy. You may cancel your subscription anytime via your account dashboard. Cancellation takes effect at the end of your current billing cycle, and you will not be charged for future periods."
Lifetime Deals: Non-refundable and non-transferable. By purchasing a Lifetime Deal, you acknowledge that you are forfeiting the right to refund.
🔴 CRITICAL: LIFETIME DEAL AGREEMENT
What You Get: A Lifetime Deal grants you perpetual access to the specific plan tier purchased at the one-time price locked in at purchase. This is a one-time, non-refundable, non-transferable purchase.
Price Lock: The price you pay is locked forever for this specific plan tier. Future price increases for new customers do not apply to your account.
⚠️ PLAN DISCONTINUATION CLAUSE (MOST IMPORTANT): If Zeneith discontinues, significantly modifies, merges, or changes the plan you purchased in the future, Zeneith shall have NO responsibility or liability to you whatsoever. This includes but is not limited to:
YOU ACCEPT THIS RISK BY PURCHASING A LIFETIME DEAL. No refunds, credits, compensation, or alternative plans will be provided if the plan is discontinued or modified. You agree to waive any claims related to plan changes.
Access Revocation: Zeneith may revoke Lifetime Deal access if: (1) you violate these Terms, (2) you engage in fraudulent activity, (3) you exploit the Service, (4) you breach our Acceptable Use Policy, or (5) your account poses risk to Zeneith, other users, or third parties.
No Support Guarantee: Lifetime Deals include access to the plan features as they exist. Zeneith does not guarantee technical support, priority support, or any support level beyond what is included in the plan tier purchased.
No Upgrade Path: Lifetime Deal holders cannot upgrade to higher tiers at a discount or special rate. Upgrades require purchasing an additional Lifetime Deal or subscribing to a monthly plan.
User Cancellation
You may cancel your subscription anytime via your account dashboard. Cancellation takes effect at the end of the current billing cycle. You will not be charged for the next billing period.
Zeneith's Right to Suspend/Terminate
Zeneith reserves the right to suspend or terminate your account immediately, without notice, if: (1) you violate these Terms, (2) you engage in fraudulent or illegal activity, (3) you exceed usage limits, (4) payment fails, (5) you harass staff or users, (6) your account poses risk to others, or (7) you're subject to legal sanctions.
Data Upon Termination
Upon cancellation or termination, your account and data will be retained for 30 days. After 30 days, all data will be permanently deleted unless legally required to retain it. You are responsible for backing up important data before cancellation.
Our IP: All Service content, software, algorithms, design, graphics, and functionality are owned exclusively by Zeneith or its licensors and protected by Indian copyright law (Copyright Act, 1957), trademark law, and international intellectual property treaties.
Your IP: You retain all rights to your User Content (brand data, products). You grant Zeneith a worldwide, non-exclusive license to use, process, and analyze your User Content solely to provide the Service and generate reports.
You may not use Zeneith's name, logos, trademarks, or branding without written permission. Any unauthorized use constitutes trademark infringement and will result in legal action.
You are solely responsible for any content you upload or provide to the Service. You represent and warrant that:
Zeneith is not responsible for User Content and does not monitor or verify any content. You indemnify Zeneith against any claims arising from your User Content.
TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW, ZENEITH SHALL NOT BE LIABLE FOR:
Cap on Liability: Zeneith's total liability to you for any and all claims arising from the Service shall not exceed the amount you paid to Zeneith in the 12 months preceding the claim, or ₹1,000 (whichever is greater).
Exceptions: These limitations do not apply to: (1) fraudulent misrepresentation, (2) gross negligence or willful misconduct, or (3) liability that cannot be limited under Indian law.
You agree to indemnify, defend, and hold harmless Zeneith and its officers, directors, employees, agents, and representatives from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Zeneith explicitly disclaims:
Your use of the Service is at your sole risk. Rankings, recommendations, and data are estimates and may not reflect actual search behavior or guarantee any specific results.
Governing Law: These Terms are governed by the laws of India, specifically the state of Delhi, without regard to conflict of law principles.
Jurisdiction: Both parties agree to the exclusive jurisdiction of the courts of New Delhi, India. You waive any objection to venue or inconvenient forum.
Notice of Dispute: Before initiating legal proceedings, provide written notice to Zeneith describing the dispute, desired resolution, and your account details. Send to: contact@zeneith.com. We will attempt resolution within 30 days of receiving notice.
